Terms and Conditions

Please read these Terms and Conditions carefully. By booking a trip with Zanki Safaris (the "Company"), you ("the Client") are deemed to have read, understood, and agreed to be bound by these Terms and Conditions.

1. Booking and Payment Process

1.1. Contract Formation: A booking is accepted and a contract exists between the Client and Zanki Safaris when the Company issues a written confirmation (e.g., invoice or email) following receipt of the required deposit.

1.2. Deposit: A non-refundable deposit of 20% of the total trip price is required at the time of booking to secure your reservation. For bookings made within 14 days of the safari start date, the full amount is immediately payable.

1.3. Balance Payment: The remaining balance of the trip price is due no later than 14 days prior to the safari start date.

1.4. Failure to Pay: If the balance is not paid by the due date, Zanki Safaris reserves the right to treat the booking as cancelled by the Client and apply the cancellation charges set out in Clause 2.2.

1.5. Payment Methods: Payments can be made via [Specify methods, e.g., bank transfer, credit card]. All bank charges, transaction fees, and exchange rate losses must be borne by the Client.

2. Cancellation and Refunds

2.1. Cancellation by Company
Zanki Safaris reserves the right to cancel any trip due to reasons of Force Majeure (see Clause 12) or circumstances beyond the Company's control. In the unlikely event of cancellation by the Company, the Client will be offered either:
a) A full refund of all monies paid.
b) An alternative safari or travel arrangement of comparable standard, if available.
The Company is not responsible for any incidental expenses the Client may have incurred as a result of the booking, such as visas, non-refundable flights, or travel insurance premiums.

2.2. Cancellation by Client
Cancellation notice must be received by Zanki Safaris in writing (via email). Cancellation charges are calculated based on the date the written notice is received by the Company, as a percentage of the total trip price:

Note: Specific permits (e.g., gorilla, chimpanzee) and internal flight costs may be 100% non-refundable from the time of booking.

3. Changes to the Itinerary

3.1. Changes by the Client
Amendments to the confirmed itinerary will only be made without an administrative charge if they do not lead to increased operating expenses for Zanki Safaris. Any resultant additional charges levied by suppliers must be borne by the Client.
Should the Client choose to depart from the safari voluntarily or involuntarily after the start date, they shall be responsible for all subsequent costs incurred due to their early termination, including, but not limited to, new transportation and accommodation fees.
No refunds will be issued for any pre-booked or prepaid safari components-such as meals, sightseeing opportunities, or scheduled services-that the Client fails to utilize due to their own independent actions.

3.2. Changes by the Company
While Zanki Safaris will make every effort to adhere to the confirmed itinerary, the Company reserves the right to make minor changes when necessary due to circumstances outside of its control, such as road conditions, weather, operational needs of third-party suppliers, or unforeseen vehicle breakdowns. If a significant change (e.g., a change of accommodation to a lower standard for the majority of the trip) is required, the Client will be notified immediately and offered the choice of:
a) Accepting the revised arrangements.
b) Accepting an alternative date or safari.
c) Cancelling the trip and receiving a refund of all monies paid, minus the cost of any non-recoverable supplier fees.

3.3. Changes by Third Party
Zanki Safaris disclaims liability for any disruption, financial loss, delay, or harm that arises from circumstances beyond our direct and reasonable control. This specifically covers issues stemming from the actions or omissions of independent third-party suppliers, airline scheduling changes, and any event defined under the Force Majeure clause.
Any supplementary costs incurred due to such third-party disruptions-for example, the need for additional transport or extra nights of accommodation-will be the sole responsibility of the Client, who is expected to cover these through personal funds or comprehensive travel insurance.

4. Changes in Prices

The price of your safari is based on known costs at the time of booking. Zanki Safaris reserves the right to impose surcharges up to 30 days prior to departure in the event of unforeseen increases in the cost of government taxes, park entrance fees, fuel, or adverse currency fluctuations that significantly impact the cost of providing the services.
If the surcharge exceeds 10% of the total price, the Client is entitled to cancel the booking and receive a full refund of all monies paid, excluding non-recoverable third-party costs.

5. Liability

5.1. Third-Party Suppliers: Zanki Safaris acts as an agent for third-party suppliers (e.g., airlines, hotels, lodges, transport companies, and ground handlers). The Company shall not be held liable for any loss, damage, injury, death, or delay caused by the actions, omissions, or negligence of these third-party suppliers.

5.2. Inherent Risks: The Client acknowledges that safaris and travel in developing regions like Tanzania involve inherent risks. The Client assumes all such risks and is solely responsible for ensuring they are fit and able to undertake the trip.

5.3. Limitation of Liability: Zanki Safaris' liability to the Client shall be limited to proven negligence on the part of the Company or its direct employees. Under no circumstances will the Company's liability exceed the total price paid by the Client for the safari.

6. Fitness and Medical Information

6.1. Guest Responsibility: The Guest confirms that they are physically and medically fit to participate in all activities included in the safari itinerary. It is the Guest's responsibility to ensure that their health condition allows for safe participation in activities such as game drives, walking safaris, boat excursions, and travel through remote areas.

6.2. Mandatory Medical Disclosure: The Guest is required to disclose to Zanki Safaris, at the time of booking or immediately upon becoming aware, any medical conditions, disabilities, allergies, mobility limitations, or special requirements that may affect participation in the safari or require additional support. Zanki Safaris reserves the right to refuse participation in certain activities if such conditions pose a risk to the Guest or others.

6.3. Medication and Personal Medical Supplies: The Guest is responsible for carrying their own prescribed medication and any necessary medical equipment. Safari destinations may be located in remote areas where medical facilities, pharmacies, and emergency services are limited or unavailable.

6.4. Assumption of Risk and Liability: By participating in the safari, the Guest acknowledges and accepts that safari activities involve inherent risks, including those related to wildlife, terrain, and outdoor environments. Zanki Safaris shall not be held liable for any injury, illness, or health complications arising from pre-existing medical conditions, undisclosed health information, or the Guest's failure to obtain adequate insurance.

7. Amendments by Company

Zanki Safaris reserves the right to update or amend these Terms and Conditions at any time. The most current version will be published on the Company's website and will govern all bookings made after the date of publication.

8. Travel Insurance

Comprehensive travel insurance is mandatory for all Clients. The insurance must cover personal accident, medical expenses, emergency air ambulance and repatriation, and cancellation/curtailment. The Client must provide proof of adequate insurance coverage upon request. Zanki Safaris strongly recommends that insurance is purchased at the time of booking confirmation.

9. Travel Documents, Visa and Entry to Tanzania

It is the sole responsibility of the Client to ensure they possess a valid passport (valid for at least six months beyond the date of departure from Tanzania) and all necessary visas, permits, health certificates, and other required travel documents for entry into Tanzania and Zanzibar. Zanki Safaris cannot be held liable for any refusal of entry or associated costs due to lack of proper documentation.

10. Luggage and Valuables

10.1. Luggage Limits: Due to space and weight restrictions on safari vehicles and internal flights, luggage is generally restricted to [Suggest 15-20] kg per person in a soft-sided bag. Excess baggage charges may apply or luggage may have to be stored at the Client's expense.

10.2. Responsibility: Clients are responsible for the safety and security of their personal belongings and valuables at all times. Zanki Safaris cannot be held responsible for loss or damage to luggage unless caused by the proven negligence of the Company's direct employees.

11. Complaints

Should the Client have a complaint, it must be reported to the Zanki Safaris guide or representative immediately to allow the Company the opportunity to resolve the issue while the Client is on the safari. If the issue is not resolved locally, a formal complaint must be submitted in writing to Zanki Safaris within [Suggest 30] days of the safari end date. Failure to follow this procedure may limit the Client's rights to compensation.

12. Force Majeure

Zanki Safaris shall not be liable for any delay in performance or non-performance of its obligations where the cause is a "Force Majeure Event." A Force Majeure Event means any circumstances beyond the Company's reasonable control, including, but not limited to, acts of God, war, threat of war, civil strife, industrial dispute, terrorist activity, natural disaster, fire, road closures, government action, epidemic or pandemic disease.

13. Images and Marketing

The Client consents to Zanki Safaris using any photographs or video footage taken by the Company's staff or contractors during the safari for promotional, marketing, and advertising purposes in any medium without payment or compensation. If the Client does not agree to this, they must advise the Company in writing prior to departure.

14. Governing Law

The Client and Zanki Safaris agree that the laws of the United Republic of Tanzania shall govern these Terms and Conditions and the contract between them. Any dispute arising shall be subject to the exclusive jurisdiction of the Courts of Tanzania.
